Alohi’s provision of Fax.Plus is conditioned on your acknowledgement of, and agreement to the below terms as well as Terms of Service. Unless otherwise defined in these Product-Specific Terms, capitalized terms will have the meaning given to them in the Alohi Terms of Service and Privacy Policy.
1.1. Product description. Fax.Plus is an easy, secure and reliable online faxing solution, available across many platforms. Fax.Plus integrates with a large number of third-party services. This online fax service was developed for individuals and companies that need to send and receive faxes without investing in fax machines and fax servers (“Fax.Plus Services”).
2.1. Local numbers. Upon signing up for Fax.Plus Services you will be provided one or more local numbers by us (“Fax.Plus Numbers”). You have no title over Fax.Plus Numbers and acknowledge that we are their sole owner. Fax.Plus Numbers will be provided to you according to the rules and regulations of the local number provider. Purchased numbers from us cannot be ported out, but numbers that were previously ported in from another provider can be ported out. In case of an error or change in the telecommunications services provided by our suppliers, or any occurrence of discrepancies by third-party suppliers that may cause problems in Fax.Plus Service, we hold no responsibility and you void any claim or objection in this regard.
2.2. Limitation of services. We reserve the right to prevent fax submission to certain destinations.
2.3. Unsolicited advertisements. In the United States under the Federal Telephone Consumer Protection Act of 1991 (TCPA), in the European Union under the Privacy and Electronic Communications Regulations 2003, and in the laws of many other countries, states and provinces, the transmission of unsolicited fax advertisements is illegal. We reserve the right to immediately suspend or terminate your use of Fax.Plus if you send unsolicited fax advertisements and / or spam.
3.1. Pricing policy. Each Subscription Plan contains several pages that are included in each plan. If you want to send and/or receive more pages than are included in your Subscription Plan, you will need to add credits (“Fax.Plus Credits”) to your Fax.Plus Account. The extra price for transmission of exceeding pages can be checked at Fax.Plus Pricing, and will be deducted from your Fax.Plus Credits accordingly. Most fax pages take less than sixty (60) seconds to transmit. However, for each inbound or outbound transmission, the number of pages charged is calculated based on the greater between the actual number of pages sent or received and the number of full and partial 60-second increments of transmission or connection time, whether or not the transmission occurs or is completed (such as instances when someone answers the call or transmission is interrupted before completion). For example, a one-page fax with a transmission duration of thirty (30) seconds is recognized as one page and a one-page fax with a transmission duration of one minute and six seconds is recognized as two pages. Also, faxes sent to certain destinations may count as multiple pages. You can check the fees for fax transmissions to all destinations at Fax.Plus Rates.
3.2. Unused subscription plans credits. The amount of pages included in your Subscription Plan is valid only for a one month period and does not roll over to the next month. For example, if your Subscription Plan includes one hundred (100) pages per month and you only use fifty (50), the remaining fifty (50) pages will not add to the one hundred (100) pages you will have in the following month under your Subscription Plan. However, if you add extra credits to your Fax.Plus Account in order to send or receive more pages than are included in your Subscription Plan and do not use all of the extra credits in that specific month, the outstanding extra credits will roll over to the next months, until you use all of your extra credits. No refunds will be made for unused pages included in your Subscription Plan or for unused extra credits.
3.3. Deactivation and allocation of Fax.Plus numbers. If your Account does not have a sufficient amount of credit to extend your monthly or yearly subscription, your Fax.Plus Number will be deactivated at the end of the billing cycle. Random numbers will be revoked from your Account fourteen (14) days after deactivation and Custom/Golden/Ported numbers after a thirty (30) days period. Once your Fax.Plus Number is revoked, you will lose access to that Fax.Plus Number and its settings. Your Fax.Plus Number might be allocated to someone else after it passes our internal allocation procedures. Alohi may delete your stored information and data and settings, as well as allocate your Fax.Plus Number to someone else, after it passes our internal allocation procedures.
3.4. Cancelation of paid subscription plans. In addition to the cancellation terms set out in the Terms of Service, upon expiration or termination of the Subscription Plan, you will lose access to your Fax.Plus Number.
4.1. Cooling-off period and refund policy. When you purchase extra credits or perform any purchase directly from us you will be entitled to a cancellation period of 24 hours (“Cooling-Off Period”) unless you have made use of the Fax.Plus Credits in any way (e.g. if Fax.Plus allocates you a Fax.Plus number or if you send or receive a fax), in which case the Cooling-Off Period will be extinguished, and your purchase cannot be canceled or refunded. Outside of the Cooling-Off Period, nothing is refundable.
4.2. Allocation of Fax.Plus numbers. You hereby expressly agree that Fax.Plus Numbers may be allocated to you before the end of the Cooling-Off Period and become non-refundable upon allocation.
4.3. Cooling-off period limitations. The Cooling-Off Period and refunds do not apply to payments made in order to subscribe to one of our paid Subscription Plans or any purchase that is (i) made via a third party partner of Alohi (please contact the partner directly, who may decide, at its sole discretion, whether or not to pay a refund), (ii) not directly acquired online from us (e.g. vouchers or pre-paid cards) (iii) paid for in cash using third party payment methods (such as a cash payment wallet) and (iv) paid for and allocated to your Account by a manager, administrator or another user.
4.4. Misuse. We reserve the right to refuse a refund request if we reasonably believe (i) that you are trying to unfairly exploit this refund policy, for example, by making repetitive refund requests in respect of the same Alohi Service; (ii) if you are in breach of Alohi Terms or (iii) if we reasonably suspect that you are using Alohi Services fraudulently or that your Account is being used by a third party fraudulently.
5.1. Warranties. As outlined in the Terms of Service, the Alohi Websites and Alohi Services are provided “as is” and on an “as available” basis and without warranties of any kind, save as for those provided to users subscribed to our enterprise plan and subject to the Service Level Agreement.
